These Terms of Service govern your access to and use of the Jupiter Winter online store and your purchase of products from us.

The store is operated by SKY BLUE MUSIC LLC, doing business as Jupiter Winter (“Jupiter Winter,” “we,” “us,” or “our”). Our store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.

By accessing the store or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Refund and Return Policy.

2. Eligibility

You must be legally capable of entering into a binding contract to place an order. If you are under the age of majority where you live, you may use the store only with the involvement and permission of a parent or legal guardian.

You agree to provide current, complete, and accurate account, billing, delivery, and contact information.

3. Products and availability

We make reasonable efforts to describe and display our products accurately. Colors and appearance may vary by screen, and handmade, embroidered, screen-printed, or manufactured products may contain minor natural variations.

Product mockups may differ slightly from final manufactured products. We may limit quantities, restrict availability by destination, correct errors, or discontinue a product where reasonably necessary.

Adding a product to a cart does not reserve it. An order is subject to acceptance and product availability.

4. Preorders

Many Jupiter Winter products are sold as preorders. A preorder is placed before manufacturing and fulfillment are complete.

Estimated shipping dates are displayed on product pages, in our FAQ, or in our Shipping Policy. Estimates may change because of manufacturing, freight, customs, carrier operations, or circumstances outside our reasonable control.

If a material delay occurs, we will provide notice and any opportunity to accept the delay, cancel, or receive a refund required by applicable law.

5. Orders and acceptance

After an order is submitted, you should receive an electronic confirmation. This confirms that we received the order but does not necessarily mean that we have accepted it.

We may refuse or cancel an order for legitimate reasons, including:

  • Product unavailability

  • An obvious pricing or description error

  • Suspected fraud or unauthorized payment

  • A delivery restriction

  • Violation of these Terms

  • A quantity that appears intended for unauthorized resale

If we cancel an order after payment has been collected, we will refund the affected amount.

6. Prices and payment

Prices are displayed in the currency selected by or available to the customer. Taxes, shipping charges, customs duties, and other charges will be shown or described where applicable.

International customers may be responsible for customs duties, VAT, import taxes, brokerage fees, or carrier charges unless checkout specifically states that they are included.

You agree to provide valid payment information and authorize the applicable charge for your order.

7. Shipping and delivery

Physical orders are delivered according to our Shipping Policy.

Depending on the customer’s location and the products ordered, fulfillment may occur from the United States, United Kingdom, or another disclosed fulfillment location.

Customers are responsible for providing a complete and accurate shipping address and for promptly notifying us of any requested correction.

Risk of loss and legal title transfer according to applicable law. Nothing in these Terms overrides mandatory rights concerning delivery, loss, damage, or non-delivery.

8. Returns, refunds, and cancellations

Returns, refunds, exchanges, and cancellations are governed by our Refund and Return Policy.

Limited-run and preorder products are generally final sale for change of mind or incorrect sizing, except where applicable law provides a mandatory right to cancel or return an order.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

9. Digital products and The Vault

Digital products may include album downloads, demos, voice notes, photographs, written material, and access to private folders or services.

Unless expressly stated otherwise, purchasing digital content gives you a limited, personal, non-exclusive, non-transferable license to access and use that content for private, non-commercial purposes.

You may not:

  • Share private access links

  • Reproduce or distribute the content publicly

  • Upload the content to another platform

  • Resell, sublicense, or commercially exploit it

  • Remove copyright or ownership notices

  • Circumvent access restrictions

Ownership and intellectual-property rights remain with Jupiter Winter and the applicable creators or licensors.

10. Intellectual property

The store and its content—including music, recordings, photographs, artwork, logos, product designs, text, video, graphics, and downloadable material—are owned by or licensed to Jupiter Winter and are protected by applicable intellectual-property laws.

No content may be copied, reproduced, modified, distributed, sold, or commercially used without prior written permission, except as allowed by law.

11. Acceptable use

You must not use the store:

  • For unlawful, fraudulent, or abusive purposes

  • To interfere with the store’s security or operation

  • To transmit malicious code

  • To scrape or collect information without authorization

  • To infringe another person’s rights

  • To impersonate another person

  • To attempt unauthorized access to an account, system, or digital product

We may restrict access when reasonably necessary to protect the store, our customers, or our rights.

12. Third-party services

The store may use or link to services operated by Shopify, payment providers, carriers, Dropbox, social platforms, and other third parties.

Those services may have their own terms and privacy practices. We are not responsible for a third party’s independent acts or omissions except to the extent required by law.

13. Errors and corrections

Occasionally, information may contain typographical errors, inaccurate descriptions, incorrect prices, or availability errors.

We may correct an error or update information. If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

14. Disclaimer

We will provide products and services with the care and quality required by applicable law.

To the maximum extent permitted by law, the store and its content are otherwise provided on an “as available” basis. We do not guarantee uninterrupted access or that every technical issue will be corrected immediately.

This section does not exclude warranties, guarantees, or consumer protections that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Jupiter Winter will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer remedies.

16. Governing law

These Terms are governed by the laws of California, UNITED STATES, without regard to conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the laws of the country where you ordinarily reside.

Any dispute will be handled by a court with lawful jurisdiction. Before commencing formal proceedings, we encourage customers to contact us so we can attempt to resolve the matter.

17. Changes to these Terms

We may update these Terms when our products, practices, services, or legal obligations change.

The effective date at the top identifies the latest version. Changes apply prospectively and do not reduce rights already attached to a completed purchase.

18. Severability

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

19. Entire agreement

These Terms, together with the policies incorporated into them and the information presented during checkout, form the agreement governing purchases through the store.
